Acceptance of Terms

By accessing or using the Birch Road platform or any associated services (collectively, the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

These Terms apply to all users, including individuals completing the guided journey experience, advisors accessing the dashboard, and any other parties who interact with the Platform in any capacity.

Who We Are

Birch Road Associates is a wealth stewardship advisory practice based in Oakland, California. We operate the Platform to deliver guided stewardship experiences and advisory services to individuals, families, and financial professionals.

Platform Access and Eligibility

The Platform is intended for adults aged 18 and older. By using the Platform, you represent that you meet this requirement.

Access to the Platform is granted by invitation or through direct registration. Birch Road reserves the right to restrict, suspend, or terminate access at any time, for any reason, without notice.

Your access to the Platform is personal and non-transferable. You may not share your login credentials or magic link access with any other person.

Intellectual Property

Our content is ours. All content on the Platform — including but not limited to the guided journey experience, module structure, reflection prompts, synthesis methodology, advisory frameworks, knowledge base entries, briefing formats, engagement tier definitions, and all associated text, logic, and design — is the proprietary intellectual property of Birch Road Associates, LLC and is protected by applicable copyright, trade secret, and intellectual property laws.

You may not reproduce, copy, or exploit our methodology. Without the prior written consent of Birch Road Associates, LLC, you may not:

  • Copy, reproduce, distribute, or publicly display any portion of the Platform or its content

  • Reverse-engineer, decompile, or attempt to extract the underlying methodology, prompts, frameworks, or logic of the Platform

  • Use the Platform's structure, question design, synthesis approach, or output format as the basis for a competing product or service

  • Scrape, crawl, or systematically extract content from the Platform by automated or manual means

  • Represent any content derived from the Platform as your own original work without attribution

Your journey responses are yours. The written responses you provide during the journey experience remain your own. By submitting them, you grant Birch Road Associates a limited license to use them to deliver your synthesis briefing, improve our methodology on an anonymized basis, and share them with your designated advisor where applicable.

Advisor Use

Advisors who access the Platform agree to the following additional terms:

  • You may use the Platform and its outputs only to serve clients whose data you are authorized to access

  • You may not reproduce, distribute, or commercially exploit the Platform's methodology, frameworks, or knowledge base content outside of your direct advisory practice without written permission from Birch Road Associates, LLC

  • You may not white-label, resell, or represent the Platform as your own product or proprietary methodology

  • Client data accessed through the advisor dashboard is confidential and must be handled in accordance with applicable professional standards and regulations

Prohibited Uses

You agree not to use the Platform to:

  • Violate any applicable law or regulation

  • Impersonate any person or entity

  • Interfere with or disrupt the Platform's infrastructure or security

  • Attempt to gain unauthorized access to any part of the Platform or its underlying systems

  • Use the Platform for any commercial purpose not expressly authorized by Birch Road Associates, LLC

No Professional Advice

The Platform delivers structured synthesis and reflection outputs based on your responses. These outputs are not financial advice, legal advice, tax advice, or therapeutic services. Nothing on the Platform or in any associated communication constitutes a professional advisory relationship unless explicitly established through a separate written engagement agreement with Birch Road Associates, LLC.

Disclaimers

The Platform is provided "as is" without warranty of any kind. Birch Road Associates, LLC makes no representations about the accuracy, completeness, or fitness for purpose of any content or output generated by the Platform. We reserve the right to modify, suspend, or discontinue any feature of the Platform at any time.

Limitation of Liability

To the fullest extent permitted by applicable law, Birch Road Associates, LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Platform, even if advised of the possibility of such damages.

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Alameda County, California.

Changes to These Terms

We may update these Terms from time to time. We will notify active users of material changes by email. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
